The Kano High Court presided by Justice Amina Adamu Aliyu has granted leave for the National Chairman, All Progressives Congress (APC), Abdullahi Umar Ganduje, to be served by substituted means in a criminal case prefered against him by the Kano State government.
The court, while ruling on an ex parte application by the prosecution, yesterday, also granted leave for his wife, Hasfat Ganduje, his son, Umar Abdullahi, and two other respondents to be served by publications in two widely read national newspapers.
The leave was made sequel to an ex parte application brought before the court by the prosecution led by Zaharaddeen Kofar Mata. The judge, however, overruled the objections raised by the counsel to the sixth respondent in the case, Nuremi Jimoh, SAN, against the ex parte order.
Jimoh (SAN) had also raised objection over the appearance of the prosecution counsel on grounds that the fiat for appearance in the case was issued to Adeola Adedife (SAN) and not him. The learned SAN had insisted that a fiat cannot be shared with any other lawyer, even as the prosecution counsel had claimed that he was duly assigned and given the fiat to appear in the case.
Justice Aliyu, thereafter, adjourned the case to July 11, 2024, for the counsels to address the court on the matter.
The case was reassigned to Justice Amina Adamu Aliyu by the Kano State Chief Judge, Justice Dije Abdu Aboki. It was previously before Justice Usman Malam Na’abba of the Kano State High Court before the reassignment. Ganduje, his wife, son and four other respondents were not present or represented in court at yesterday’s sitting.
