Prolonged closure of court may justify state of emergency in Osun – NBA warns

The Forum of Nigerian Bar Association branches in Osun State has warned that the prolonged closure of court may justify lack of capacity of the state government and thereby justify declaration of state of emergency.

The union, in a letter signed by the Chairmen of Osogbo, Ikirun, Iwo, Ife and Ilesa branch, Maruf Adediran, Niyi Akinsola, F.O Ajani, Ayodele Olawoye and Ramond Oki, and copied Governor Ademola Adeleke, Assembly speaker, Adewale Egbedun; Chief Judge, Justice A. O. Ojo; State Attorney General, Wole Jimi-Bada SAN, and the state chairman of Judiciary Staff Union of Nigeria (JUSUN), Idris Adeniran, yesterday, expressed surprise that some employees of the state government have been frustrating the peace move.

“We want Your Excellency to note that the prolonged paralysis of the Judiciary may also attract escalated Federal attention, considered as inability of the State to maintain law and order through its Judicial institutions and lead to constitutional breakdown, which, in extreme scenarios, may justify a declaration of a state of emergency, which we do not pray for in Osun State,” the association said.

Noting that the NBA had undertook a series of interventions aimed at resolving the crisis since the commencement of the strike on 22nd September 2025, lamented the persistent refusal of staff to honour the invitation of the chief judge.
The association said it had held formal engagement with the leadership of JUSUN, during which the union outlined their long-standing grievances concerning unpaid allowances, delayed promotions,and the non-sitting of the JsC.

They said a follow-up meeting with the Honourable Chief Judge of Osun State to verify the JUSUN’s allegations was held, which the CJ denied with clarification that she had already directed the Secretary of the JSC to convene a meeting to deliberate upon.

The association said a meeting with the Attorney General where the Bar leaders emphasized the urgent need to convene the JSC meeting was held and the Attorney General assured the delegation of his commitment to ensuring the meeting was held.

They said another joint meeting was supposed to be held between the Hon Chief Judge, the leadership of the Bar and the JUSUN leadership but the said meeting was boycotted by JUSUN, saying “despite those extensive efforts, no concrete progress has been made,as the JSC has continued to fail to sit due to the refusal of government-appointed members to attend the convened meeting.

“This situation,if allowed to continue unchecked,poses grave constitutional, economic,and security risks to the State.
“More troubling is the deliberate refusal of the members of the JSC (appointed by Your Excellency) to attend the lawful meeting summoned by the Honourable Chief Judge for the purpose of addressing JUSUN’s grievances.Their refusal undermines the authority of the Chief Judge and the Chairman of the JSC and frustrates the only lawful mechanism available for resolving legal disputes.”

The association urged governor Adeleke to respond the communique of the congress of all lawyers in Osun State held on the 4th day of December 2025 at Osogbo City Hall, Olonkoro, Osogbo, where it urged the governor to direct the leadership of JUSUN to suspend the ongoing strike and immediately resume work within the next seven days, in the interest of public order, constitutional governance, and the wellbeing of the citizens of Osun State.
