Ojukwu transport, Bianca’s property dispute adjourned again over missing file

Proceedings in the protracted property dispute between Ojukwu Transport Limited (OTL) and Ambassador Bianca Ojukwu and her sons have been adjourned for the second time in six weeks after the case file was again unavailable at the Lagos High Court sitting in Ikeja.

The matter, before Justice A.M. Lawal, could not proceed after the court was informed that the case file had not been returned, forcing another adjournment.

The latest development follows a similar setback on May 8, 2026, when proceedings were also stalled due to the absence of the court records.

Reacting to the development, Ojukwu Transport Limited expressed concern over what it described as the repeated disappearance of the case file, alleging that the records had been taken from the Ikeja Judicial Division to Lagos more than two months ago for the execution of a warrant and had yet to be returned.

The company noted that the legal representatives of Bianca Ojukwu and her sons were absent on both adjourned dates.

According to OTL, the recurring unavailability of the file has continued to frustrate proceedings and raises concerns about the handling and accountability of court records.

Amid the delays, the company disclosed that it had filed and served a motion for stay of execution before the Court of Appeal, seeking to restrain enforcement of the judgment pending the determination of its appeal against the 2022 judgment in Suit No. LD/1539/2012.

OTL maintained that the application became necessary following moves to enforce the judgment despite the pending appeal. The company further contended that the properties in dispute had earlier been the subject of a warrant of execution arising from a separate judgment delivered in 2018 by Justice Adedayo Oyebanji in Suit No. LD/794/2011.

One of the directors of Ojukwu Transport Limited, Dr. P. Ike Ojukwu, was present in court on both adjourned dates.

The company is represented by Ifeanyi Okumah and Chief O. Ugolo, SAN, while Bianca Ojukwu and her sons are represented by Nick Omeye & Co.
