N50m loan: Andy Uba was never governor, court told

The controversy over execution of court judgment against Senator Andy Uba on an alleged N50 million debt owed Oranto Petroleum seems unending, with a High Court of the Federal Capital Territory, Abuja being told that the senator was never a former governor of Anambra State.

The court was also told that Senator Uba merely usurped the office of the governor of the state for 17 days and was unseated by a judgment of the Supreme Court, wherein the court declared that he was never a governor of the state.

These averments were contained in a 32-paragraph affidavits sworn to and filed in the court registry by a litigation secretary, Mr. Stephen Okpoh, in the law firm of Ike Ike and Associates with the authority of Prince Arthur Eze, Chairman of Oranto Petroleum Ltd, who is the judgement creditor in a suit of non-payment of a N50 million loan.

The court was further told that Senator Uba benefitted from the governorship primary election of his political party, the All Progressives Congress (APC) conducted ahead of the 2021 governorship election in Anambra State, which all three tiers of courts in Nigeria have invalidated. It said that contrary to his claim, Senator Uba was also not a brother or friend of Oranto Petroleum Ltd, which is a limited liability company that does not share human consanguineous relationship.

The court was told that Senator Uba’s former personal assistant fleeced Prince  Eze of $1 million, which he eventually recovered through a court judgement, that was executed.

Senator Uba went to court to challenge the execution of an earlier judgement against him, claiming that the recovered property does not belonged to him.

A state High Court sitting in Ekwulobia, Anambra State had entered judgement in favour of Oranto Petroleum Limited in the case it instituted against Senator Uba over non-payment of N50 million interest free loan granted to him by Oranto Petroleum Ltd owned by Prince Eze, which led to the seizure of some of his property by officials of the Federal Capital Territory High Court enforcement unit Abuja.

Senator Uba had however filed a motion pleading for a court order to pay back the loan in instalments of N1 million monthly which the judgment creditor has rejected in his counter-affidavits, describing it as a ploy not to pay back the loan.

Oranto Petroleum had claimed further in the counter-affidavits opposing the N1 million monthly instalmental payment that Senator Uba did not disclose to the court his income and assets in his motion papers as required by law.
