Katy Perry loses trademark case to Australian designer Katie Perry

Katie Perry, an Australian designer, won the right to sell clothing under her name on Wednesday, ending a years-long trademark dispute with US singing megastar Katy Perry.

Designer Katie Perry accused her considerably more famous namesake of trademark infringement, claiming she owned the “Katie Perry” brand before the singer became a global hit.

But songstress Katy Perry said her music had already gone “viral” as the designer started selling clothes around 2008, and sought to have the Australian trademark scrubbed out.

An Australian court agreed with the musician, declaring in 2024 that the apparel trademark should be cancelled.

However, Australia’s High Court has now found in favour of the local designer on appeal, concluding that there was unlikely to be any chance of “confusion” between the two.

A representative for the artist told AFP that, despite the legal action, she “has never sought to close down” the Australian company.
