Kano Court Grants Leave for Ganduje to be Served by Substituted Means

A Kano High Court, presided over by Justice Amina Adamu Aliyu, has granted permission for Abdullahi Umar Ganduje, the National Chairman of the All Progressives Congress, to be served by substituted means in a criminal case filed against him by the Kano State government.

During Wednesday’s proceedings, the court, ruling on an ex parte application by the prosecution, also granted leave for Ganduje’s wife, Hafsat Ganduje; his son, Umar Abdullahi; and two other respondents to be served by publication in two widely circulated national newspapers.

This decision follows an ex parte application presented to the court by the prosecution, led by Zaharaddeen Kofar Mata.

Justice Aliyu overruled objections raised by Nuremi Jimoh SAN, counsel to the sixth respondent, regarding the ex parte order.

Jimoh SAN also objected to the prosecution counsel’s appearance, arguing that the fiat to appear in the case was issued to Adeola Adedife SAN, not Kofar Mata. The Senior Advocate of Nigeria insisted that a fiat cannot be shared, while the prosecution counsel maintained that he was formally assigned and given the fiat to appear.

Justice Aliyu adjourned the case until July 11, 2024, for counsels to address the court on the matter.

The case was reassigned to Justice Aliyu by the Kano State Chief Judge, Justice Dije Abdu Aboki, after initially being heard by Justice Usman Malam Na’abba of the Kano State High Court.

During Wednesday’s proceedings, Ganduje, his wife, his son, and the four other respondents were not present and were not represented in court.
