The Economic and Financial Crimes Commission (EFCC) has appealed the judgment of the Federal Capital Territory (FCT) High Court in Abuja, which awarded N10 million in damages to former Minister of Power, Olu Agunloye, over a social media publication linking him to the alleged $6 billion Mambilla Power Project fraud.
The Commission, through its counsel, Wahab Shittu (SAN), filed a notice of appeal at the Court of Appeal, Abuja, on Friday, July 10, challenging the entire judgment delivered by Justice Peter Kekemeke on July 8, 2026.
In the appeal, filed in Suit No. FCT/HC/CV/1199/2024, the EFCC expressed dissatisfaction with the trial court’s decision, urging the appellate court to set aside the judgment in its entirety.
The anti-graft agency anchored its appeal on 11 grounds and is seeking four principal reliefs, including an order allowing the appeal, setting aside the High Court judgment, dismissing Agunloye’s suit in its entirety, and granting any further orders the court may deem appropriate.
Justice Kekemeke had held that the EFCC’s publication concerning Agunloye was false, defamatory, and injurious to his reputation, and consequently awarded the former minister N10 million in damages.
In addition to the appeal, the EFCC has also filed an application for a stay of execution of the judgment pending the determination of the appeal.
No date has been fixed for the hearing of the appeal.
