The National Chairman of the Action Alliance (AA), Chief Kenneth Udeze, has commended a ruling by the Court of Appeal sitting in Akure, which granted his application to withdraw as an interested party in a suit challenging the leadership of the party.
Udeze had filed two separate motions on notice CA/AK/268M/2025 and CA/AK/309M/2025 seeking the court’s leave to withdraw from the matter.
He argued that the issues raised in the suit had already been settled by courts of competent jurisdiction in favour of his leadership of AA.
The application followed a judgment by the Federal High Court, Osogbo Division, in Suit No. FHC/OS/CS/34/2025, delivered on September 29, 2025.
That judgment formed the basis for the motions filed at the Court of Appeal in Akure, even as several Court of Appeal rulings affirming Udeze’s leadership of the party remained in force.
Udeze maintains that those Court of Appeal decisions take precedence over the Federal High Court judgment, noting that appellate rulings are binding on all persons and authorities in Nigeria.
He further pointed to a pending appeal at the Supreme Court Appeal No. SC/CV/162/2024, Adekunle Rufai Omoaje & Others v. Chief Uzewuru Nwachukwu & others challenging a Court of Appeal, Abuja Division judgment delivered on January 26, 2024, which had also affirmed his position as the authentic National Chairman of AA.
