The Directors of Jigsimur Plus responding to the Patent and Registry ruling on their label bottle design ownership spoke through their legal representatives as follows: that the attention of Jigsimur Plus Nigeria Limited has been drawn to recent reports and publications concerning the ruling delivered by the Patents and Designs Registry, Abuja, in the dispute for ownership of label bottle design involving Jigsimur Plus Nigeria Limited, Jigsimur SA (Pty) Ltd and Cleansimur International Ltd.
For the avoidance of doubt, we wish to state that the said ruling is an administrative decision of the Patents and Designs Registry and does not constitute a final and conclusive determination of the parties’ rights by a Court of competent jurisdiction.
Jigsimur Plus Nigeria Limited strongly maintains that the decision was reached in error and without proper appreciation and consideration of the relevant facts, documents, rights and circumstances surrounding the matter.
We have therefore instructed our Legal Counsel to take the necessary steps to challenge the said administrative decision before the Federal High Court of Nigeria and to seek appropriate judicial remedies.
We are, within the period prescribed, exercising our lawful right to challenge the decision and are taking the necessary steps to pursue our appeal and obtain appropriate orders preserving the position of the parties pending the determination of the appeal.
It is therefore misleading to present the matter publicly as having reached a final and enforceable conclusion when the period prescribed by the ruling has not expired and the appellate process is being invoked.
We have full confidence in the integrity of the appellate process and our entitlement to pursue the remedies available to us. Wewill neither be distracted by premature declarations nor deterred from protecting our name, goodwill and proprietary interests through lawful means.
Accordingly, members of the public, our customers, distributors, business partners and other stakeholders are urged to disregard conclusions suggesting that the dispute has been finally resolved as the matter is far from finally determined, and Jigsimur Plus Nigeria Limited remains committed to vigorously protecting and enforcing its lawful rights and interests.
It is important that the public should not misconstrue the administrative ruling as a final judgment of the Federal High Court or any other superior court of record.
Jigsimur Plus Nigeria Limited will pursue the matter through the appropriate judicial process and is confident that the relevant facts, evidence and legal issues will be properly considered by the Court.
We further urge members of the public and the media to exercise restraint and avoid relying on or disseminating reports suggesting that the matter has been finally and conclusively determined.
We remain committed to conducting ourself with dignity and respect for the rule of law, and are confident that the issues in dispute will ultimately receive their proper determination through the appropriate legal channels. This publication is therefore issued to set the record straight and to protect the interests of Jigsimur Plus Nigeria Limited, its customers, distributors, business partners and the general public.
