The traditional ruler of Alamo of Ayegbaju-Ijesa in Atakumosa East Local Government Area of Osun State, Oba Abideen Adeyemi, has dragged the Department of State Service (DSS) to the Court for alleged infringement on his fundamental rights.
The monarch in a suit filed before the Federal High Court, Osogbo, on August 5, a copy of which was obtained by Daily Sun yesterday, joined the Director General, the state director, DSS, Mr Geordi, Mr Amosat, Chief Omololu Afilaka and Rotimi Ajewole, as respondents.
In the suit filed by his counsel, Soji Oyetayo, the applicant sought an order of the court, restraining the 5th and 6th defendants from using the instrumentality of the office of the 1st and 2nd respondents from further harassing, humiliating, arresting, detaining or curtailing his freedom of movement and his right to personal liberty.
He faulted the action of the DSS via a malicious and frivolous petition writes by the 5th and 6th respondents, saying that the 1st to 4th respondents deprived him (the applicant) of his fundamental rights as enshrined in chapter IV of the Nigeria constitution.
“The 1st and 2nd respondents, forcefully in commando style, harassed, humiliated, arrested and took away the applicant and his driver ,while driving on the highway in Osogbo without prior notice/invitation.
“The DSS detained the applicant and his driver for two days, from the 8th day of July to the 10th of July, 2024, when no gun was found in the applicant’s possessions or that of his driver who drove him,” the application added.
He, thereby, sought an order of the court to award the cost of N50 million as general damages being the loss suffered by the applicant.
