The National Judicial Council (NJC) has advised aggrieved family of former Director of Military Intelligence, late Gen. Ibrahim Sabo, to petition an Upper Sharia Court judge, Ado Ahmed Mukhtar over alleged plot to sell Abuja property.
The Council specifically advised the family to write a petition against the judge to the Federal Capital Territory (FCT) Judicial Service Committee over the allegations.
NJC was responding to a letter by the family of late Gen. Sambo, dated March 12, 2025, alleging plans to sell their family inheritance.
In a letter by the Secretary of the NJC, Ahmed Gambo Saleh, on behalf of the Chief Justice of Nigeria, Justice Kudirat Kekere-Ekun, the NJC said the issues complained of, “are not within the Council’s constitutional mandate, but that of the State Judicial Service Commission (JSC).
“You are therefore, advised to address your petition to the Chief Judge of the Federal Capital Territory, Abuja, who is the Chairman of the FCT Judicial Service Committee, please.”
The family had agreed not to share the property of their father, but the wife of one of their siblings, who had a two year old son before his death, brought a petition seeking to claim the sum of N22 million her share and N170 million for the boy, based on the value of the property located at Wuse 2, Abuja, respectively.
The judge had on February 26, 2025, ordered the family to produce the sum of N22 million to the woman based on the calculated share of the property when divided by eight, while the boy is to earn N170 million when he is old enough.
However, while the family was trying to gather the N22 million, the judge allegedly requested the family to produce the sum of N170m unfailingly or the court would sell the property to recover the sum.
In a letter to the Chief Judge of the FCT High Court and signed by Ahmed Ibrahim Sabo, the family further alleged that the judge refused to avail them records of the proceedings to enable them appeal against the verdict.
He wrote,”We had to file a motion before the Shariah Court of Appeal seeking for leave to appeal out of time. The Shariah Court of appeal has fixed July 16, 2025, to hear our motion, but to our utter shock, the Court registrar,Wasilat called me on phone to say that the Judge wants to see us in his chamber last week Monday.
“Our lawyer went and he directed that we should pay the plaintiff N22, 000,000 on or before Friday July 4.
“We raised the funds and wrote to the court on Friday July 4,requesting for the bank account details to make the payment but they refused to release. Instead, the judge said we have to bring another N170, 000,000 within two hours on Friday or else he would sell the property on Monday July 7, 2025.
“We want to use this medium to call on the Chief Judge of the FCT Husseini Baba Yusuf to intervene and stop this brazen injustice and judicial corruption by Ado Ahmed Mukhtar.
“How can a judge execute judgment on a matter that is already before the Shariah Court of Appeal and we have served him with the motion for stay of execution? Why is he desperate and why can’t he wait for the outcome of the appeal?”
Meanwhile, the judge did not respond to calls.
