A Chief Magistrate Court, sitting in Dutse, Jigawa State, has struck out a criminal case against three former Commissioners under former Governor Sule Lamido administration for criminal breach of trust and conspiracy to defraud the state.
The Chief Magistrate court Judge, Bar. Ahmed Lamin in his judgment declared that, “the state Attorney General despite having the powers to institute criminal charges against any offender however noted that such charges shouldn’t be presented to the court in piece meal”.
Lamin said in order not to appear to have deliberately cause to intimidate or harass the alleged offenders the attorney General should concurrently submit all the charges levied against the offenders before the court rather than doing so in piece meal”, he stated.
The judge stated that he has struck-out the charges and declared that the accused persons be released.
But the prosecuting Counsel Barrister Musa Muhammed Imam quickly declared their intention to appeal the judgment while the defense counsel Barrister Yakubu Ruba applaud the judgment.
The commissioners whom have served in various capacities as ALGON officials include Alhaji Nasiru Umar, Alhaji Salisu Indirawa and Alhaji Abba Daguro.
They were earlier arraigned in court by the state Attorney General of Jigawa State on four count charges that contravene section 97, 312, 123(A) and 287 of the Jigawa penal code.
