A Federal High Court sitting in Kano and presided over by Justice Abdullahi Mohammed Liman has voided the reinstatement of Emir Muhammadu Sanusi .
The court, which delivered its ruling yesterday, specifically nullified all the actions taken on the strength of the repealed Kano Emirate Law by the Kano State Government .
The presiding judge, Justice Liman declared: “I hereby order that every step taken by the Government is hereby nullified and becomes null and invalid, and that this does not affect the validity of the repealed Emirates Law, but actions taken by the Governor, which includes assenting to the Law and reappointment (of Sanusi)”.
He continued “I have listened to the audio of the Governor both in Hausa and English after assenting to the Law, and I am convinced that the respondents are aware of the order of maintaining status quo pending the hearing and determination of the motions on notice in the court.
“Having been satisfied that the respondents are aware of the court order, the court in exercise of its powers, set aside the action because it is in violation of the court’s order. I think it is a very serious matter for anyone to flout the orders of the court and go scot-free with it.”
The Court held that the situation could have been averted if the respondents followed the due process by complying with the court order, which would still have allowed them to carry out their assignments.
The judge regretted that the respondents, however, decided to act according to their whims and caprices.
Daily Sun recalls that an aggrieved kingmaker in the Kano Emirate, Aminu Babba Danagundi, the Sarkin Dawaki Babba, had approached the court over the violation of his fundamental human rights following the appointment of Muhammad Sanusi as the Emir of Kano by the Kano State Government.
In the meantime, there is noticeable anxiety among residents in the metropolis following the judgement of the court on the matter.
However, the police in the state have made notable deployment of its personnel across the key areas with a view to ensuring law and order in the state.
