The Action Democratic Party (ADP) has notified the Independent National Electoral Commission (INEC) and the Senate of a constitutional vacancy in the Plateau North Senatorial District seat following the resignation of Senator Pam Dachungyang.
ADP stated that Dachungyang was duly nominated, sponsored and elected on the platform of the party in the senatorial election conducted on Saturday, 3 February 2024.
Its National Chairman, Yabaji Sani, in a statement yesterday, said the party further noted that the lawmaker has since resigned from the party, which sponsored his election.
According to Sani, the matter is governed by the provisions of Section 68(1)(g) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), which provides that a member of the National Assembly shall vacate his seat upon leaving the political party that sponsored his election, except in constitutionally recognised circumstances of division or merger.
He clarified that no such circumstances exist in this instance.

He disclosed that the party has written to the leadership of the Senate to notify it of the constitutional implications of the resignation and to request that appropriate parliamentary procedures be observed.
“The party has also communicated with INEC to take notice of the vacancy and to make the necessary administrative preparations in line with constitutional and electoral timelines, subject to formal transmission by the Senate and/or orders of a court of competent jurisdiction.
“The Party emphasised that its actions are guided solely by respect for the Constitution, the rule of law, and democratic due process, and are taken without prejudice to any judicial proceedings that may be initiated to obtain constitutional clarification and enforcement.
“ADP reaffirmed its commitment to protecting the electoral mandate freely given by the people of Plateau North Senatorial District and to upholding constitutional order within Nigeria’s democratic system,” he said.
