Two legal practitioners, including the Legal Adviser to the Benue State Chapter of the All Progressives Congress, APC, Fidelis Mnyim and his cohort, Odunsanya George walked into troubled waters after swearing to a court affidavit containing false information against a former Attorney General of the Federation and Minister of Justice, Chief Michael Aondoakaa, SAN.
Already, an Abuja Chief Magistrate, Elizabeth Wonini, has ordered the police authorities to investigate them on the crime of perjury which attracts a sentence of 14 years imprisonment.
The police was given 14 days to conclude its investigation and report to the court with its findings.
According to a direct criminal summons filed against them by the ex- AGF, “On or about the 28th day of June 2022, the defendants who are both within the jurisdiction of the court, being legally bound under oath did make statement which they knew to be false before the Federal High Court, Abuja in suit No: FHC/ABJ/CS/938/2021 and thereby committed an offence contrary to section 156 of the Panel Code and punishable under section 158 of the Penal Code.”
They defendants are accused of lying on oath by supplying false information in a suit No: FHC/ABJ/CS/938/2021 filed at the Federal High Court, Abuja.
A Motion on Notice was filed by Chief Mike Mamman Osuman, SAN, seeking to change counsel(Aondoakaa) in the suit and also re -open the case which was adjourned for Judgement.
An affidavit was deposed to by the two lawyers wherein they lied that Aondoakaa came to Court personally on April 27, 2022 and conceded the case of the 1st APC in the suit instituted by APC members, seeking the deregistration of the party.
They said Aondoakaa didn’t file any processes before the court amongst others.
However, the records of the court showed that Aondoakaa filed preliminary objections to the suit and even joined issues with the plaintiffs.
Furthermore Aondoakaa was not in court on April27, 2022 when the case was not argued and adjourned.
A lawyer from the law firm of the former AGF, Jacob Apera, argued the case on April 27, 2022 for APC and he never compromised or conceded the case of APC as falsely claimed .
Notwithstanding, the court has since overruled the application and proceeded to deliver its judgment which Aondoakaa’s law firm eventually won the case in favour of APC.
