Osun court dissolves five‑year marriage over alleged victimisation

The Chief Judge of Osun State, Justice Oyebola Adepele‑Ojo, has dissolved the five‑year marriage of Ms. Arowolo Afopefoluwa and Mr. Isiaka Oluwatoyin.

Ms. Afopefoluwa, who filed the petition, told the court that the couple married in 2021, but she endured continuous abuse, frustration and victimisation by her husband.

She tendered the marriage certificate and sought dissolution under Section 15(1) of the Marriage Causes Act, saying cohabitation effectively ceased in January 2021 and the marriage produced no children.

In her judgment, Justice Adepele‑Ojo accepted the petitioner’s evidence of intolerable conduct and agreed that the respondent’s behaviour made it unreasonable for the petitioner to continue the marriage.

“The respondent has behaved irresponsibly that the petitioner cannot reasonably continue to stay with him,” the judge held.

Finding that the marriage had irretrievably broken down, the court granted the dissolution.
