Ogun land dispute suit dismissed, N100,000 cost awarded against claimant

Justice O.A. Onafowakan of the Ogun State High Court, Abeokuta, has dismissed a land dispute suit filed by  Nurudeen Aina against Olajide Odutayo and Olabiyi Odutayo over a property located in Imedu-Nla, Mowe Town.

Justice  Onafowakan struck out the case following an application by the claimant seeking to withdraw the suit against the defendants.

In his ruling, Justice Onafowakan held that the claimant’s case lacked further grounds for consideration after the withdrawal request, thereby ordering its dismissal.  The court also awarded costs of N100,000 against Aina in favour of the defendants.

“In the result, the claimant’s claim against the defendants shall and is hereby, dismissed  with costs assessed at N100,000 against the claimant in favour of the defendants,” the judge ruled.

Aina had approached the court seeking several reliefs, including a declaration that the defendants were trespassers on a parcel of land situated at Imedu-Nla in Obafemi Owode Local Government Area of Ogun State. The land in question was described in Survey Plan No. OG/5258/2023/16, prepared by licensed surveyor Ogundunmade Tunde and dated September 11, 2023.
