A chieftain of the All Progressive Congress (APC) in Lagos State, James Omolaja Odunmbaku, and others may face trial for contempt over their alleged disobedience to court’s order.
Justice Yhaqub Oshoala of the Lagos State High Court, Ikeja, had, on May 24, 2022, ordered the parties in a suit, ID/11239LMW/2021, to maintain status quo ante bellum.
The judge gave the order following an interlocutory injuction filed before the court by Mr. Olufemi Fasehun (for himself as the administrator to the estate of the late Ebenezer Olawanle Oladipo Fasheun and on behalf of the beneficiaries to the estate) against Odunmbaku, Mr. Cletus Nwagwu, Mr. Oluwadare Olanrewaju and others.
Fasheun had approached the court through his lawyer, Otunba Remi Adeoye of Destiny and Lawlords, to seek an order of interlocutory injunction restraining Odunmbaku and others, either by themselves, their servant, agents or privies from breaking in, entering, penetrating, occupying and forcefully taking up possession of landed property, which is a subject matter of litigation, pending the final determination of the case before the court.
The property is located at No. 10, Kudirat Abiola Way, Oregun, Ikeja, Lagos State, measuring approximately 9185.06 square yards, delineated in survey plan, dated 14th October, 1960, prepared by Surveyor Adekunle Kukoyi and registered as No. 6 at page 6, in volume 431, at the Land Registry Office, Ibadan, vide Deed of Conveyance dated January 1961.
After hearing of the claimants’s application, Justice Oshoala subsequently, issued an order of mandatory interlocutory injunction compelling the defendants to forthwith stop trespassing on the said land pending the final determination of the suit.
However, despite the order, the claimant lawyer, Adeoye, had alleged that one of the defendants, Odunmbaku and his cohorts has been disobeying the court’s order.
Adeoye threatened to commence contempt proceedings against Odunmbaku and his associates, urged members of the public to note that the said land belong to the family of late Ebenezer Olawanle Oladipo Fasehun being represented by Mr. Olufemi Fasehun and that members of the public should be wary in dealing with Odunmbaku in respect of the land.
