Judge orders sale of Gen. Sabo’s property against NJC advice, pending suits

An Upper Sharia Court Judge, Ado Ahmed Mukhtar has ordered the sale of the Abuja property of the late Director of Military Intelligence (DMI), Gen. Ibrahim Sabo against the advice of the Council as well as a pending cases in court.

Specifically, the judge issued a writ dated July 31, 2025 ,for the attachment and sale of the property, against the advice of the NJC as well as pending cases in court.

The said writ issued in respect of suit No: CV/27/2024 reads: “Whereas a writ has been issued by this court for the attachment and sale of the immovable property of the said Estate of Gen. Ibrahim Sabo in performance of the said judgment order.

“You are hereby ordered forthwith to levy the sum of N200m still remaining due to the above named Halima Aliyu Muhammad under the said judgment/order together with the cost of this writ and the cost of executing the same by the attachment of the immovable property of the said Estate of Gen Ibrahim Sabo, wherever such property may be found within the area of jurisdiction of this court…”

Meanwhile, family members of late  Sabo have accused Mukhtar of acting against the advice of the National Judicial Council NJC and pending court cases over the disputed property.

The NJC had, on March 18, 2025, in a letter signed by Secretary Ahmed Gambo Saleh, directed the Sabo family to forward their petition to the FCT Judiciary, which has the constitutional mandate to deal with the matter.

In compliance with the NJC directive, the family on April 4, 2025, forwarded the petition to the FCT Judiciary Service Commission, with the assurance that the commission had waded into the matter.

However, while the said petition was pending, the family on yesterday,alleged that the property had been placed for sale by the court.

The family and their widowed mother, Ruth, said the attachment would attract would-be buyers to their property in breach of their rights to a fair hearing and privacy despite the pendency of suit :FCT/HC/10055/2025, between Ruth Sabo & ors vs Hon. Ado Muktar Ahmed before an FCT High Court.

Trouble started after the family had agreed not to share the property of their late father, but the wife of one of their siblings, who had a two-year old son before his death, brought a petition seeking to claim the sum of N22 million her share and N170 million for the boy as his adult inheritance, based on the value of the property located at Wuse 2, Abuja, respectively.

The judge had, on February 26, 2025, ordered the family to produce the sum of N22 million to the woman based on the calculated share of the property when divided by eight, while the boy is to earn N170 million when old enough. 

However, while the family was trying to gather the N22 million, the judge allegedly requested the family to produce the sum of N170 million unfailingly or the court would sell the property to recover the sum.

In a letter to the Chief Judge of the FCT High Court and signed by Ahmed Ibrahim Sabo, the family further alleged that the judge refused to provide them with records of the proceedings to enable them to appeal against the verdict.

“We want to use this medium to call on the Chief Judge of the FCT,  Husseini Baba Yusuf to intervene and stop this brazen injustice and judicial corruption by Ado Ahmed Mukhtar.

“How can a judge execute judgment on a matter that is already before the Sharia Court of Appeal, and we have served him with the motion for stay of execution? Why is he desperate? Why can’t he wait for the outcome of the appeal?”

Meanwhile, the judge did not respond to calls.
