Court suspends sharing of derivation funds to oil producing states

The Abuja division of the Federal High Court has restrained the Accountant General of the Federation from the distribution of more than One trillion naira due to oil producing states pending the determination of the suit before it.
Justice Ahmed Mohammed made the preservative following an exparte that brought before his court by the Imo State Government.
In the substantive suit marked FHC/ABJ/ CE/415/22022, the Imo state government is challenging the distribution of the money without unambiguous indices by the Revenue Mobilization, Allocation and Fiscal Commission(RMAFC) as provided by the 1999 constitution
After listening to counsel to the plaintiff, Chief Olusola Oke (SAN), who expressed the need to preserve the res, Justice Mohammed barred the Accountant General of the Federation from distribution the money.
Meanwhile, Justice Mohammed has ordered the Imo state to join other oil producing states as respondents to the suit.
He consequently adjoined the matter to June 15, 2022 for hearing of the motion on notice.
The suit which was instituted by the Imo state Attorney General on behalf of the has the Accoutant General of the Federation, RMAFC and the Attorney General of the Federation as defendants.
