A Federal High Court sitting in Osogbo, the Osun State capital, has reserved ruling on bail of a member of Osun Park Management System, Olalekan Oyeyemi (aka Emir) till further notice.
The defendant was arraigned on March 13th, 2024, on eleven count charges including conspiracy, unlawful killing, malicious damage, and acts of terrorism.
During the argument on bail by the parties on Tuesday, counsel to the defendant, Edmund Biriomoni, told the court that a formal application had been filed and served on the prosecution.
He urged the court to grant his client bail, saying “The prosecution counsel has filed a five-paragraph counter application to our bail but we have replied to them. I am not saying the offenses are bailable but bail is at the discretion of the court,” Biriomoni said.
Prosecution counsel, Francis Ossai, urged the court to deny the bail of the defendant, noting that a counter motion had been filed to that effect.
Citing section 165 of the Administration of Criminal Justice, 2015, the prosecutor submitted that the court reserves the power to deny bail, particularly when there is reasonable ground to believe
that the defendant will where released on bail commit another offense or attempt to evade trial.
Justice Emmanuel Ayoola thereby adjourned the ruling on the bail application, noting that the date will be communicated to the parties.
