Following the released of legal advice by the Directorate Public Prosecution (DPP), the Lagos State Magistrates’ Court has ordered for the remand of Shamsiseen Oluwo and Sunday Olabayo in prison, pending their arraignment before the State High Court over alleged unlawful possession of firearms .
Apart from the remand order, Magistrate B.A Sonuga also discharged and acquitted Lawal Ibrahim, Idowu Mujaheed, Dare Majekodunmi, and Gbenga Demorin,who were charged alongside the duo of Shamsiseen Oluwo, and Sunday Olabayo, for attempted murder and illegal possession of firearms.
The court’s order was as a result of the DPP’s legal advice. The defendants were docked before the court by the Inspector General of Police (IGP).
In the legal advice from the DPP, with reference number CB:3510/X/FHQ/ ABJ/PPRO/VOL.11/96, the letter held that there was sufficient evidence to establish a prima facie case of conspiracy and unlawful possession of firearms against Shamsudeen Oluwo,and Sunday Olabayo. The legal advice also indicted the duo for wilful damage to property and forcible possession.
Also in the letter, DPP advised police to follow-up investigation on Murphy Adebare Ademoye (Topaz), Sule Razak (Success), Lawo Oyewole (Fake General), and Kamoru Lamina (Sir K) for their alleged involvement in orchestrating the crime.
The letter read in part:”Facts contained in the duplicate case file reveal that the fact as alleged by the complainant is that White-Rose Properties and Estate Development Limited, acquired acres of land from Yeguda Resettlement Land Scheme with government Certificate of Occupancy and has been in possession of same with every other document executed.
That of recent, Mr. Razaq( a.k.a. Success )(2), Mr. Kamoru Lamina( a.k.a Sir K Oluwo) (3), Mr. Samson Olajide Oluwo (a.k.a Ese Olobo ),and Mr.Lawo Oyewole (a.k.a. Fake General) conspired to assassinate Mr. Saheed Audullahi Mosadoluwa by paying the sum of N12,000,000 to one Mr.Samson Olajide Oluwo, and his brother( aka Mr. Junior “D” Killer) who are working with one Mr. Sunday Olabayo.
He alleged further that the above-named persons were planning to assassinate him in order to take over his properties as they have stationed armed thugs on the land 24/7 with a clear directive to eliminate anyone on the land. That they have been threatening his life and that of his company staff to assassinate them if seen. That the above-named persons are renowned land grabbers in Lagos,with criminal records of killing and murdering innocent people especially when it comes to valuable land within Lagos and Ogun State”.
