A Federal High Court sitting in Lagos has granted bail to a businessman, Mr. Benson Royal Enyinnah, docked for alleged conspiracy and fraud amounting to over N87 million.
The bail granted by Justice Akintayo Aluko was sequel to an application filed and argued by his lead counsel, Chief Benson Ndakara.
He had pleaded with the trial judge to temper justice with mercy by allowing his client to be coming from home to face the trial assuring that he would not jump bail citing legal authorities to support his arguement.
Upholding the arguments, the judge admitted the defendant on bail in the sum of N10 million with two sureties in like sum. One of the sureties, the court held, must be a land owner within the jurisdiction of the court while the second must be a top government functionary on grade level 14.
Other conditions was that the sureties must show evidence of three years tax payment.
Justice Alukoalso ordered the defendant to deposit his travelling documents before the court.
Prior to the arraignment, Ndakara had on behalf of his client filed a fundamental rights application challenging the continued detention of the defendant without trial describing the action as unconstitutional, null and void.
Benson had pleaded not guilty to the charges when he was docked on charges of conspiracy and fraud alongside his wife said to be at large and his three companies. Names of the companies were given as Glory Energy Company Limited, Petroyal Energy Company Limited and Glonnek Energy Resources.
They were alleged to have defrauded Obimma Benedicta Chinazor, Chioma Ifeanyi Chukwu, Vivian Ifeoma Ndukwu and Chidiebere.A.Okoli and Greenland Energy Limited.
The offence was said to have been committed between the previous year and May 2022.
