Communal land tussle: Court restrains Evbuotubu from trespassing Okhiaro community land

An Edo State High Court sitting in Benin City, has restrained the people of Evbuetubu Community and one Frank Irabor, from further invading Okhiaro community in Egor Local Government Area of the State.

Recall that Pa. Osarenren Enogieru (Okhiaro Village Head), Chief Obamedo Odeh (Okhiaro Chief Priest), Pa. Obazee Omorovbiye Igbinosu and Obazee Ekpen had on behalf of Okhiaro dragged Evbuetubu Community Head, Pa. Edigin Evbonaye.

Mr Friday Agbonkina, Frank Irabor and six others to court over alleged encroachment of their land and malicious destructive of their properties.

The claimants through a Motion on Notice seek an Order of Interlocutory injunction from the court, restraining the nine defendants, their servants, agents and privies from further invading, selling or trespassing their land pending the determination of the substantive suit in court.

The people of Okhiaro claimed that the people of Evbuetubu had on December 26, 2022 mobilised themselves to their community (Okhiaro to demolished houses and cars belonging to them

They also told the court that because of the incessant acts of invasion of their community (Okhiaro) land and destruction of their properties by the people of Evbuetubu, they can no longer live in peace because of fear of being attacked by Evbuetubu.

Ruling on the application, Justice Courage Ogbebor ruled that “the defendants are hereby restrained from further act of invasion of the community of the claimants and causing destruction of properties.

“The parties are to maintain the Status quo ante bellum over the parcel of the land, the subject matter in this suit.

“The case is adjourned to 4th of December, 2023 for hearing,” Justice Ogbebor ruled.
