The Chief Executive Officer of Web Towers Limited, Felix Ezeamama, has reclaimed ownership of his property situated at Number 41, Kingsway Road (now Alfred Rewane Road), Ikoyi, Lagos State after a long legal battle.
Alhaja Halima Abubakar and others had dragged Felix Ezeamama, Web Towers Limited and others to court over the property.
But in a consent judgment entered by Justice E. Alakija of a Lagos State High Court sitting in Lagos, on June 11, 2023, Mr. Ezeamama has reclaimed the property.
Justice Alakija, had in the judgment, said: “The 1st and 2nd defendants entered appearance, filed their memorandum of appearance and filed their amended statement of defence and counter claim dated February 24, 2020.
“The 4th defendant equally filed a statement of defence dated August 10, 2020. The claimants filed reply to the 3rd and 4th defendants statement of defence dated October 21, 2020.
“Following the discussions held by the claimant and the 1st, 2nd and 4th defendants, parties mutually agreed to settle their dispute amicably out of court.
“This has culminated in the filing in court on July 10, 2023, a terms of settlement dated July 10, 2023, and executed by the claimant and the defendants in this suit.
“The terms of agreement was brought to the Notice and attention of the court on the sitting of July 10, 2023.
“In her oral submission before the court, counsel for the claimant submitted that parties have met and settled this case and filed terms of agreement dated July 10, 2023.
“He urged the court to adopt and enter the Terms of Settlement as the Judgment of this Court.
Counsel for the 1st and 2nd defendant confirmed the position as stated by the claimant’s counsel and equally urged the court to adopt the terms of settlement as the judgment of this court.
“I have listened carefully to the application and submission of the learned counsel for the claimant.
The court has noted the reaction of the counsel for the 1st and 2nd defendants and has perused carefully the records of the court especially the process titled “Terms of Settlement which form part of the records of this court.
“The court finds that the Terms of Settlement are the voluntary agreement between the claimant and the defendants and also noted that the claimant and the defendants duly executed the Terms of Settlement and same witnessed by both counsel to the parties.
“In view of the above, the court is satisfied that the Terms of Settlement has been duly executed.
The parties having negotiated and agreed on the amicable settlement of this matter hereby urge this court to enter the followings terms as the judgment of this court in this matter, namely:
*The claimant shall accept from the Ist & 2nd defendants the sum of N100million only as full and final settlement of her claims against all the defendants in this matter.
*The claimant shall within 30 days of the payment of the said sum of money to her by the 1st and 2nd defendants vacate the two apartments over which she lays ownership claims and occupies situate at and known as Block A, Flats 1 and 2 (bungalow) at No. 41, Kingsway Road, Ikoyi, Lagos State and relinquish vacant possession of same to the 1st and 2nd defendants who shall take possession, own and demolish any structure on same forthwith.
*The claimant shall sign any documents) which may be required of her by the 1st and 2nd defendants for the effectual transfer of ownership, and/ or registration of title of the said property, to the 1st and 2nd defendants or their nominee (s) or in their names without demanding any further payment from them.”
