Benue: Court stops removal of APC chairman

Justice Theresa Igoche of the Benue State High Court has restrained the leadership of the ruling All Progressives Congress, APC, from dissolving the Augustine Agada led State Executives of the party pending the determination of the motion on notice filed by the applicants.
The interim order was sequel to a motion exparte marked MHC/1585M/2024 filed by the Hon. Augustine Agada-led EXCO members of the party.
Others listed as applicants on the motion paper are Dr. Stephen Tsav; Vencent Uji; Bishop Ogabji; Princes Awuese Torhee; Daniel Morgan Ihyomun; David Hangeior; Aluor Simon and Hassan Mohammed.
According to the certified true copy of the enrolled order dated August 21, 2024, the judge directed the applicants to serve the sole respondent (APC) with the order as well as the motion on notice.
Justice Igoche who signed the enrolled order has been adjourned further proceedings to August 28, 2024.
Comrade Agada has been battling with the state governor, Rev Fr Hyacinth Alia, who created a faction led by the State Welfare Officer, Benjamin Omakolo as Acting Chairman.
In granting the exparte motion, Justice Igoche ruled, “I have looked at the processes filed along with the application, particularly exhibit MT “I” attached to the affidavit in support and I am satisfied that the application has merit.
“In the circumstance, I hereby grant the application as prayed. This order shall be served on the respondent forthwith, along with the motion on notice which motion is fixed for hearing on August 28, 2024.”
Specifically the court restrained the leadership of the APC , its agents, privies,or assignees, staff, Representatives, or whomsoever however described from removing, changing, replacing or howsoever terminating the tenure of the applicants and other members of the Benue State Working Committee of the APC until the expiration of their four year term in office pending the determination of the motion on notice.
Following the crisis rocking the Benue State chapter of the APC, Agada and his state EXCO have approached the court to the party from terminating his tenure before the expiration of his four year term.
Benue APC has been in crisis since the inauguration of the Benue State House of Assembly which produced Hon. Aondouna Dajoh against Hon. Becky Orpin all of the APC.
