The Court of Appeal sitting in Jos has dismissed the appeal filed by Amb. Yohanna Margif, challenging the eligibility of Dr. Patrick Dakum as the authentic governorship candidate of Labour Party for the 2023 elections in Plateau State.
Margif, who was not satisfied by the judgement of Federal High Court Jos that dismissed his suit filed to challenged his alleged substitution as the candidate of the party, had approached the Appeal Court to seek redress.
The presiding Judge, Justice Ebiowei Tobi in a ruling on Thursday upheld the judgement of the lower court and described the appeal for lack of merit.
According to Justice Tobi, “having gone through the processes and grounds of the appeal filed by the Appellant (Amb.Margif) the matter is hereby dismissed for lack of locus standing.
” The Federal High Court Jos was right in its decision, and the status quo should be maintain.”
Similarly, the Court of Appeal also dismissed an appeal filed by an APC governorship aspirants in Plateau State,
Danyaro Dakon Sarpiya who was challenging the election of Dr. Nentawe Yilwatda as the governorship candidate of the APC in Plateau.
The presiding Judge, Justice A.A Gumel upheld the Judgement of the Lower Court which said Sarpiya had not resigned from his place of work as at the time of the party primaries and was not eligible to contest the election.
Reacting to the Judgement, the Governorship Candidate of the All Progressives Congress (APC), Nentawe Yilwatda described the outcome of the case filed against him at the Court of Appeal as a victory for all.
In a statement signed by the spokesman for Generation Next Campaign Council, Shittu Bamaiyi said Nentawe has instructed is followers not to celebrate the court victory since it was a family affairs.
He pointed out that the appellants in the matter are members of the APC and that they had every right to challenge the outcome of any decision of the party in court.
Nentawe maintained that he bears no grudges against anyone who feels otherwise over his election as the party’s flagbearer for the forthcoming governorship contest.
Nentawe remarked that since the appeal court has reaffirmed the credibility of his election it behoves the people aggrieved to bury the hatchet and join hands with other members of the party to work for the victory of party at all levels.
He commended the State party executive council, the campaign machinery and the teeming supporters of the APC working collectively towards the success of the party at the polls.
