Aokete Lighting Electronics Industry Ltd, Mega Benjamin & Eric Nigeria Ltd, Chen Xiao Ming, He Lian Chan, Gaoxi Ong, and Elochuksu Aganama have asked the Federal High Court, Federal Capital Territory (FCT) to lift its order restraining them from using the AKT trademark.
A letter addressed to the Deputy Registrar, Federal High Court 2, Abuja, FCT, by counsel to Aokete Electronics and others, M. I. Dikko and Associates, made an “Application for a date for hearing on the motion to set aside and stay of execution of the order granted on December 8, 2022, which motion was filed on December 12, 2022.
“We act as Counsel to the Defendants/Applicants in the above-named suit, wherein His Lordship granted an Order on the 8th of December, 2022, whereby, in the order, my lordship expressly indicated that the defendants/applicant are at liberty to apply to set aside the order. Kindly find attached the enrolled order as Annexure A.
“We have filed, on behalf of defendants/applicants, a motion to set aside the said order which carries a prayer for stay of execution of the said order. Kindly find attached as Annexure B, the motion to set aside and for stay of execution. We, hereby, humbly apply for a date for the hearing of the said motion to set aside and for stay of execution. Importantly, the plaintiffs/respondents have been served with the application.”
Justice Binta Nyako of the Federal High Court had restrained defendants from manufacturing, importing, distributing, and advertising for the sale, products or goods bearing the words D & B AKT “AKT” pending the hearing and determination of a suit filed by Nigrshine Industry Ltd and Ugochukwu Madumere against them.
However, speaking on the suit, an official of Aokete Lighting Electronics Industry Ltd said the suit was “filed with malicious intent to disrupt and destroy the operations of his company. He accused the defendants of faking the products of his company and flooding the Nigerian market with fake products.
He added that the products of Aokete Lighting Electronics Industry Ltd are genuine and meet international standards, and assured Nigerians that his company will continue to provide them with high-quality products all the time.
